Guthart v Nassau County
Appellate Division, Second Department | 232 AD3d 854, 2024 NY Slip Op 05960 | Charges above $50, or $75 with a late fee, held preempted by state law; sent back for class certification
Supreme Court, Nassau County upheld the $30 fee in 2017 (55 Misc 3d 827). The Appellate Division reversed the dismissal in 2019 (178 AD3d 777) and on Nov. 27, 2024 held that any red-light charge above $50, or $75 with a late fee, conflicts with and is preempted by Vehicle and Traffic Law section 1111-b. The New York Post reported in October 2025 that a trial judge ruled the county need not repay about $400 million in fees; that decision itself has not been located yet.
