SUPERVISOR DESENA: Here.
CLERK SRIVASTAVA: Thank you.
SUPERVISOR DESENA: Okay, good evening, everybody. Before we begin, I would like to
recognize one of our town employees, Jonathan Staller. He is in our Highway Department, and
he's also a member of the Great Neck Alert Fire Department. So I thank I thank the fire service
always, and perhaps it is that training that had him so aware, and so willing to help. Jonathan was
right here in Manhasset on Bayview Avenue waiting at a traffic light in his street sweeper, on
duty, when he saw an older gentleman try to cross, then try and cross the other way. He didn't
notice that there was a car traveling very fast southbound on Plandome Road, but thinking fast,
and knowing that saving a life is the most important thing, Jonathan leaned on his horn, like, you
know, maybe sometimes we want to do, but he leaned on it in a very, very hard way, and this
gentlemen turned around well, but he did it, he turned around to see what was happening, and
Town Board Meeting August 11, 2026 Page 3
when he came back, narrowly missed being hit. In fact, Jonathan, you said that the his jacket
blew
MR. STALLER: Yeah.
SUPERVISOR DESENA: in the wind.
MR. STALLER: He had a light jacket on, and it moved
SUPERVISOR DESENA: Will you come up to the actually, why don't please come up to the
microphone and tell us a little bit. What went through your mind?
MR. STALLER: So I was by Starbucks, I was at the light, Bayview Avenue, facing Plandome
Road, and the gentleman, he was wearing a nice, stylish hat. So I was watching him. He tried to
cross my light, the light changed, so I was watching him, and then he started heading I don't
know, Michael. He started heading to he started heading across
SUPERVISOR DESENA: No, talk into the microphone, that way we
MR. STALLER: He started heading across
SUPERVISOR DESENA: that way we can record your story.
MR. STALLER: towards Dunkin' Donuts, and so I was watching this gentleman for a while. A
while, like 20
SUPERVISOR DESENA: Well, it's a traffic light.
MR. STALLER like 20 seconds.
SUPERVISOR DESENA: Yeah.
MR. STALLER: And then I noticed a car, because I where I was parked waiting for the light, I
could see past the butcher on the corner, and I saw this car flying down the road, and this
gentleman, unaware, didn't look, didn't even turn his head to the left, started crossing the street.
He was in the middle of the street when that car was coming, and all I could see I don't want to
tell you what I could what I was picturing.
SUPERVISOR DESENA: Right.
MR. STALLER: But, so I started honking the horn, and the sweeper horn is very low; it's like a
(makes noise), you know, European sound, but everybody started looking at me. Everyone by
Starbucks on the corer, why is this guy honking the horn? I'm honking, pointing, pointing,
somebody get this guy's attention, and this car's coming very fast, and the last second, the
gentleman, you know, he heard the horn at the last second, and as he turned around, the car
passed him, and you could see the movement of his jacket
SUPERVISOR DESENA: Mm hmm.
Town Board Meeting August 11, 2026 Page 4
MR. STALLER: from the wind of the car speeding by.
SUPERVISOR DESENA: So one of the people who witnessed this wrote to us telling us about
how this happened.
(Applause.)
SUPERVISOR DESENA: So
MR. STALLER: Thank you, everybody, appreciate it.
SUPERVISOR DESENA: So, I thank you, Jonathan. I thank the fire service for investing time
and training in you, and you know, this is right up the block from Town Hall, so you know, I
don't know who that gentleman was; it could have been one of my neighbors. So thank you, and
we have a proclamation we'd like to give you. Your son is here. Would you like to join us or take
a photo?
MR. STALLER, JR.: No.
SUPERVISOR DESENA: Okay, whatever you like. All right, would you
COUNCILMAN WALSH: Listen, I want to say something, too. My man, how does it feel to
save somebody's life? It's nice; right?
MR. STALLER: It is.
COUNCILMAN WALSH: I know, I know that. When you wake up in the morning several times
in a row, you say to yourself, wow, I saved somebody's life.
MR. STALLER: I was at a
COUNCILMAN WALSH: I appreciate that.
(WHEREUPON, a proclamation was presented and photos taken.)
SUPERVISOR DESENA: So everybody, we also just recognized Tom McDonough who has
served the residents of the Town of North Hempstead for is it 27 years?
MR. McDONOUGH: Yeah.
SUPERVISOR DESENA: Twenty seven years. That's a lot of years, that's a lot of people, and
Tom also wears many hats, and one is as a volunteer firefighter, and he has gone up the ladder,
and now is one of the officers of the Nassau County Fire Commission. So fortunately, we know
we're still going to be seeing Tom McDonough, maybe every meeting. He'll be wearing a
different hat, but Tom has so much experience with all aspects of the town. He has been the
president of our union for many years and has made sure that our employees get the best
treatment, and we we will be talking later about the most recent contract that we just entered
into, and I want to thank you, Tom, and your team, for your assistance in coming to that great
Town Board Meeting August 11, 2026 Page 5
agreement. Anyway, so Tom, we will we will miss you, but we know that you will not be a
stranger, and we thank you for your service to our employees, to our residents as a town
employee, and as a firefighter. So thank you, very much.
(Applause.)
SUPERVISOR DESENA: Ah, yes, of course, and we thank we thank
COUNCILWOMAN DALIMONTE: Can I just say something about Tom?
SUPERVISOR DESENA: Well, we just want to say that well, I'm also going to thank Noreen
Murphy for stepping into the leadership role.
(Applause.)
SUPERVISOR DESENA: We look forward to working with you, Noreen.
COUNCIL WOMAN DALIMONTE: So Tom, I'm still going to be your Councilperson now that
you're just going to be a constituent and not the C not the president of the union, but really,
honestly, I want to thank you so much because you always were there when I had a question, I
needed an answer, I wanted you to look at something. So I just really want to thank you from the
bottom of my heart for everything.
MR. McDONOUGH: Thank you.
SUPERVISOR DESENA: Okay, all right, so now we will have 30 minutes of public comment.
(WHEREUPON, there were 29 minutes of public comment.)
SUPERVISOR DESENA: Okay, we're going to move into our agenda now. That was all the
cards for public comment. I just have a few more that are on our business agenda, and the first is
Item 1.
CLERK SRIVASTAVA: We'll start with the public hearings. Item number 1. A public hearing
to consider the adoption of an ordinance affecting Langdon Road, Carle Place, New York.
COUNCILMAN TROIANO: Would anyone would anyone like to be heard about this matter?
Are there any cards; Supervisor?
SUPERVISOR DESENA: Oh, Tom McDonough. There he is with his citizen hat on.
MR. McDONOUGH: Hi, Tom McDonough, Port Washington, New York. So we started talking
about this one the last time, so, and the comment was made that there was a hazard at the
intersection, and that's the reason why the stop signs were going up. Has anybody addressed that
hazard? Because I went out and took pictures of it, and that hazard was caused by that
homeowner. Whether they're a constituent or not, they created a hazard to the rest of the public,
and J don't think anybody's done anything about it.
Town Board Meeting August 11, 2026 Page 6
COUNCILMAN TROIANO: So I know you've been a persistent visitor, frequent, I don't know,
a frequent speaker award we'll give you, but we're going to I'm going to continue this again to
MR. McDONOUGH: Okay.
COUNCILMAN TROIANO: to the September meeting. So this is just to make sure you come
back
MR. McDONOUGH: Okay.
COUNCILMAN TROIANO: because we want to keep on seeing you, Tom.
MR. McDONOUGH: Well, you know what? This time it'll it will give me time to blow up the
pictures and put them on the easels, and you know, it's that they're there. But if you're going to
continue it, please ask the Nassau County Police Department to go out and look at it and have
somebody measure them to see if those bushes, because they're Leylands; right? They're Leyland
Cypresses there, they take up a lot of room, and I think they're I believe, personally, I didn't
measure it, that they're on the right of way, and they should be removed. I think they're in the
right of way. I believe they're in our right of way, and the way that they they way he planted
them, it's ridiculous.
SUPERVISOR DESENA: In the right of way.
COUNCILMAN SCOTT: It's in the right of way.
MR. McDONOUGH: In our right of way. Thank you.
COUNCILWOMAN DALIMONTE: See you next month.
SUPERVISOR DESENA: Thank you. We don't have any other cards.
COUNCILMAN WALSH: It's going to continue; right?
SUPERVISOR DESENA: Yep.
COUNCILMAN TROIANO: Oh, I'd like to make a motion to continue to the September
meeting. I'm not sure of the date.
COUNCILWOMAN DALIMONTE: Fifteenth.
COUNCILMAN TROJANO: Whatever
COUNCILMAN SCOTT: Fifteenth.
COUNCILMAN TROIANO: The 18th?
COUNCILWOMAN DALIMONTE: September 1 Sth.

CLERK SRIVASTAVA: Thank you. Item number 2. A public hearing to consider the

Chapter 42 of the town code for the property located at 200 The Tideway, Plandome Heights,
New York 11030 and identified on the Nassau County Land and Tax Map as Section 3, Block
234, Lot 5.
COUNCIL WOMAN DALIMONTE: So I just want to let the Town Board know that we did
discuss this in the Waterfront Advisory Committee meeting last month, and the Waterfront
Advisory Committee, which was attached to the Civic, has recommended that we approve this,
but I know we have a presenter here.
MR. HALL: Yeah, that's fine, that's very nice to hear. Good evening, my name is Dan Hall, and
I'm with Land Use Ecological Services, I'm the agent for the owner, and just an existing dock
facility that they're extending to reach adequate water depth. The existing dock ends at low
water, there is no water there, you can't put a boat, it’s not safe, it's also bad for the environment,
and we're proposing to extend the dock out for the boat lift to make the dock usable and to allow
Town Board Meeting August 11, 2026 Page 8
safe separation from, you know, a boat or any structure. They will not be on the bottom; it’ll be
in the water. We have the DEC, Army Corp., Department of State, we have all the approvals, and
we're here before the Board because the length exceeds the town requirement of 150 feet, and the
width of the dock with the boat lift makes the dock wider than the 6 foot permitted, so
COUNCILWOMAN DALIMONTE: Right.
MR. HALL: it sounds like it's
COUNCILWOMAN DALIMONTE: Right, and it'll be 300 feet from the next northern dock.
Our bay constables went there.
MR. HALL: Correct.
COUNCIL WOMAN DALIMONTE: They looked at it, then we looked at it on the pictures, and
the minutes have been shared with the Clerk's Department and everyone on the Town Board.
MR. HALL: Yes.
COUNCILWOMAN DALIMONTE: So is there any cards on this?
SUPERVISOR DESENA: No.
COUNCIL WOMAN DALIMONTE: So with that, I close the public hearing, offer the resolution
and move for its adoption.
CLERK SRIVASTAVA: Councilman Troiano?
COUNCILMAN TROIANO: Aye.
CLERK SRIVASTAVA: Councilman Scott?
COUNCILMAN SCOTT: Aye.
CLERK SRIVASTAVA: Councilman Walsh?
COUNCILMAN WALSH: Yes.
CLERK SRIVASTAVA: Councilwoman Liu?
COUNCILWOMAN LIU: Aye.
CLERK SRIVASTAVA: Councilman Levy?
COUNCILMAN LEVY: Aye.
CLERK SRIVASTAVA: Councilwoman Dalimonte?
COUNCILWOMAN DALIMONTE: Aye.
CLERK SRIVASTAVA: Supervisor DeSena?
Town Board Meeting August 11, 2026 Page 9

COUNCILMAN LEVY: Excuse me; sir? Your light is on, and it's blinding. Your cell phone.
Your light is on. Your flashlight is on. Thank you.
MR. LEON: Good evening, Madam Supervisor and esteemed members of the Board. My name
is Allen, ALLEN, last name, Leon, L E ON. I'm the managing member of Leon Petroleum,
who has a long term lease with the landlord, Tabs Motors, on the gasoline service station at 200
Hillside Avenue, which is the subject of tonight's discussion. With me tonight, I have Kevin

SUPERVISOR DESENA: Mr. Leon, can you get a little closer to the microphone?
COUNCILMAN WALSRH: Yeah, I can't hear.
MR. LEON: I have

MR. LEON: With me tonight is is that better?
SUPERVISOR DESENA: Yes.
MR. LEON: I'm sorry.
SUPERVISOR DESENA: Thank you.
MR. LEON: I have Kevin O'Brien, Esq., from O'Brien Law; I have Chris Tartaglia, PE, from
Highpoint Engineering; and I have Nicholas Tortorella, PE, from Stone Stonefield Engineering.
It should be noted that I'm the only one that doesn't have any letters after their name. Okay, that
said, I would ask the Board's permission to bring Kevin O'Brien, Esq., to the microphone to
present tonight's proposal.
CLERK SRIVASTAVA: Thank you.
MR. LEON: Thank you.

COUNCILWOMAN LIU: Thank you.
MR. O'BRIEN: Thank you, Allen. Good evening, Supervisor DeSena
SUPERVISOR DESENA: Good evening.

MR. O'BRIEN: honorable members of the Board, Madam Clerk, counsel. Kevin O'Brien,
O'Brien Law, PC, offices at 462 Sagamore Avenue, East Williston, New York. Before I get
going, I just want to thank the Board for recognizing the hometown hero and the fire department
like that, you know, they're an integral part of our life, and you could see that they save people.
So I think it's a credit to you that you actually go
SUPERVISOR DESENA: Mm hmm.
MR. O'BRIEN: recognize them. I also want to recognize, though he doesn't want any attention
himself, so Mr. Leon, who is the principal of the company that has the 50 year lease and is going
to be reaching into his own pocket to make these improvements, but he's
SUPERVISOR DESENA: Uh oh.
MR. O'BRIEN: Whoa.

MR. O'BRIEN: He's a
SUPERVISOR DESENA: I think you have to move it.
COUNCILMAN SCOTT: Why don't you move it
SUPERVISOR DESENA: You want to move it over here? We don't have a fan on this side.
MR. O'BRIEN: Yeah, the wind might be
COUNCILMAN SCOTT: see it.
MR. O'BRIEN: So Mr. Leon is a Vietnam veteran. He's probably
SUPERVISOR DESENA: Yeah, it actually should be it should be facing us, but if Mr. O'Brien
needs to refer to it, you could turn it a little bit towards him as well.
MR. O'BRIEN: Okay, thank you, Chris. Yeah, so Mr. Leon is a Vietnam veteran. He's probably
one of the most conscientious, fastidious, hardworking, and hands on people that I know in the in
the petroleum industry. He's put together quite a team, I'd like to mention
SUPERVISOR DESENA: Mm hmm.
MR. O'BRIEN: Chris Tartaglia, who's probably one of the preeminent, Highpoint Engineering,
probably doing most of the gas stations that you see around Long Island, and Mr. Tortorella from
Stonefield Engineering, also a professional traffic engineer, who I think has been recognized and
has appeared before this Board in the past. Let me get to our application. It involves the property,
the existing gas station at 200 Hillside Avenue, in the unincorporated area of New Hyde Park.
It's an application to remove and replace the existing underground gasoline storage tanks, as well
Town Board Meeting August 11, 2026 Page 16
as a modification to the service station, both of which require approval from this Board. I would
ask, in order to save time, because it's applications 3 and 4
SUPERVISOR DESENA: Yes.
MR. O'BRIEN: on the calendar, they involve the same facts and circumstances, that they sort of
be merged and
SUPERVISOR DESENA: Yes.
MR. O'BRIEN: treated as one.
SUPERVISOR DESENA: Yes. Madam Clerk, can you call Item 4 as well?
CLERK SRIVASTAVA: Item number 4. A public hearing pursuant to Section 29A of the Town
Code to consider the application of Tabs Motors of Valley Stream Corp. for the installation of
two underground fuel storage tanks at the premises located at 200 Hillside Avenue in New Hyde
Park and designated on the Nassau County Land and Tax Map as Section 8, Block 3, Lots 1 to 5.
SUPERVISOR DESENA: Thank you.
MR. O'BRIEN: Okay, thank you so much. So as noted, this is application is for special permits,
essentially, for both the removal and replacement of the underground gasoline storage tanks at
this location, as well as the Board is aware almost any time a gas you touch a gas station, I think
the code defines it as a substantial change that it requires the Town Board's approval, and almost
any time you touch a gas station, it's a substantial change. In this particular instance, what's really
sort of driving the horse in this instance is, we have to remove and replace the underground
gasoline storage tanks. So that's a requirement from the Nassau from the Nassau County
Department of Health, and that sort of brings us to the table. They require double wall fiberglass
underground gasoline storage tanks. We currently have single wall, so we're trying to come into
compliance. As a result of that, we do have Nassau County Health Department approval in
connection in connection with that, but that's really one of the big primary focuses, and that job
alone is somewhere between 500 and $700,000. So in order to make it worthwhile, and if you've
been to the site, the bloom is off the rose, so we're going all in from underground, you know, up.
Just a little bit of history on the property. From my records, I see it's in a Business A zoning
district. It's got approximately 130 feet on North 2nd, about 105 on Hillside Avenue, it obviously
is on a major roadway, New York State 25B, Hillside Avenue, running east and west. It looks
like, from the records that I see, that there were buildings there in or about the 1940s. They said
that it was they sold cars, repair shop, gasoline, and I guess what they called, at the time, a
lubritorium, which I guess was just kind of like to change your oil, so they had been doing that.
The size of the existing building, a little bit in question, you know, because we think it's over
6,000 square feet. There had been some additions to the building in the past with permits we all
believe, but we think it's a little over 6,000 square feet, the existing building, and in order to get
here, procedurally, we also had to go to the Zoning Board of Appeals. We had gone to the
Town Board Meeting August 11, 2026 Page 17
Zoning Board of Appeals because we needed bulk area variances. If you look at some of the
existing improvements at the site, there are two pump islands with two multi product dispensers
on located there, but they're located, like, within 5 feet of the right of way. So when we look at
the plans, and our engineer will go into a little bit more detail than I will, but completely razing
and rebuilding it. We needed certain bulk area variances, setback variances and the like. In fact,
we actually wanted so the proposed building is 1,250 square feet. We actually wanted 1,500
square feet to make it more economically viable because when you take a look at a building,
1,500 square feet is not necessarily just the actual sales area itself, you know. When you take out
for the restroom, for the storage area, the mechanicals, the office area, and the actual sales
transaction area itself, it's a lot less than 1,500 square feet. We tried. We did appear before the
Zoning Board of Appeals or the Board of Zoning Appeals. They granted all our variances with
the exception of that one. So the plan you do have in front of you is the one for 1,250 square feet.
So the sum and substance of the improvements is the underground gasoline storage tanks. We're
proposing two. They're 12,000 gallons a piece, so we need a little waiver from the town on that,
the town's ordinance way back when was 10,000 gallons. All the tanks have been moving in a
larger direction, and one of the reasons, and our traffic engineer can attest to this is, you could
drop more fuel which means less deliveries. So we have two double walled 12,000 gallon tanks,
one of which is what they call compartmentalized, and I'm sure you've seen this before with
other stations that have been approved in the town where the compartmentalized ones will have,
in this instance, three compartments, you know, 4,000 gallons a piece. One would be premium,
one would be diesel, one would be regular. The pump islands themselves, we're proposing four
with a canopy over it. We're seeking self service operation meeting or exceeding the county's
regulations relative to self service operation which includes the fire suppression, the closed
circuit TV cameras, and the town's requirement that you have to have a canopy, so there is a
canopy over it, which holds the fire suppression system. Maybe at this time, to kind of walk you
through a little bit more of the improvements and if you have any questions, I can introduce Mr.
Chris Tartaglia who did the design work, and I think there were, quite frankly, comments from
the town that had to be incorporated, and as much as we are the professionals and like to think
that we did the greatest work in the world, sometimes with the input of the town, it actually
makes the project better. So in this particular instance, I think there were some comments. He
can indicate how we've incorporated some of these comments into the plans. Mr. Tar oh, there
you are, okay. Chris, it's all yours.
MR. TARTAGLIA: Top of the inning.
MR. O'BRIEN: He's the principle and licensed professional engineer of Highpoint Engineering.
MR. TARTAGLIA: Thank you, Kevin. For the record, my appearance, Chris Tartaglia, PE, from
Highpoint Engineering, address at 1860 Walt Whitman Road, Melville, New York 11747, and
I'm appearing tonight, of course, on behalf of the applicant. My firm prepared the engineering
design drawings for this project both including for the new underground storage tanks, as well as
for the site plan, the grading, the drainage and other items. A brief recap of what's proposed,
Town Board Meeting August 11, 2026 Page 18
although Kevin has done a pretty good job of describing it. So the project is a complete raze and
rebuild of the subject facility. We are removing a 6,000, plus or minus, square foot two story
building, replacing it with a 1,250 square foot convenience store. We are removing two multi
product dispensers that are very close to Hillside, Avenue, installing four new islands with multi
product dispensers on them, pulling them away from the roadway and making them parallel to I
got my pointer here, I can actually do that job moving them away from the roadway.
MR. O'BRIEN: I got it.
SUPERVISOR DESENA: There you go, you got it now.
MR. O'BRIEN: Sorry about that.
COUNCILWOMAN DALIMONTE: That's all right, I don't need to see.
SUPERVISOR DESENA: There you go.
MR. TARTAGLIA: So the pump islands are organized in this fashion, and the
MR. O'BRIEN: Don't hit me in the eye.
MR. TARTAGLIA: I will not, sir. The canopy is the rectangular orange building here. The
building, of course, is in the back. The green areas are the landscaped areas, which on the
property are essentially any area not utilized for a building or access aisle or pump island, we are
landscaping. Notably, the current facility has absolutely zero landscaping on it. So this is a
massive improvement aesthetically. The underground storage tanks that Mr. O'Brien mentioned,
two 12,000 gallon tanks, are going to be located on the east side of the property, and notably, one
of the improvements that was made in the initial application to the Board was that we were
removing two curb cuts from the side street, combining them into one pulled far back from the
intersection. In site planning, traffic planning, that's always a great idea. The DOT actually
prefers that. The initial iteration of what was sent to the Board was maintaining the two curb cuts
on Hillside Avenue in their current fashion which were un channelized, essentially, depressed
curb curb cuts. We had gotten word from one of the Councilpeople here that they wanted to see
this more defined as a directionalized access. We scrambled and got revised plans together in
about a couple of days’ time, but we are really happy to announce that we were able to make that
happen. So what you see on the plans that are currently before you are channelized curb cuts
which will reinforce a right in and right out only movement through this into this property from
Hillside Avenue. Now, why is that superior? Well, that's superior because Hillside Avenue is a
quite busy roadway and making that left would not be for the faint of heart, but we all know that
there's some folks out there who perhaps don't drive as smart as they should. So this will
reinforce that movement and make somebody, if they do dare, run over the curb and probably do
damage to their car. So we think that's going to discourage a lot of those illegal movements. So
in summary, and our traffic engineer, Nick Tortorella, will describe this more because they're
handling the state DOT application, but what I just wanted to touch on is that the state DOT was
Town Board Meeting August 11, 2026 Page 19
moving in this direction anyway. They wanted to see the curb cuts directionalized, though they
did not mandate, as part of their review, the channelization. So I just want to reiterate that that's
something that we incorporated based on the town comments. We're all for it, and we believe it's
a great idea. So if there's any other questions, I didn't want to go too long, I know that first
SUPERVISOR DESENA: Mm hmm.
MR. TARTAGLIA: piece went a little bit long, but I'm certainly here for any questions on the
site layout. If there's any questions on the traffic, our traffic engineer is here, and he's up next.
MR. O'BRIEN: I've got one question.
MR. TARTAGLIA: Yes, sir.
MR. O'BRIEN: Parking. Do we meet the parking requirements?
SUPERVISOR DESENA: Please, Mr. O'Brien, in the microphone
MR. O'BRIEN: I'm sorry.
SUPERVISOR DESENA: so we can record you.
MR. O'BRIEN: Parking. Do we meet the parking requirements?
MR. TARTAGLIA: Yes, we do, Mr. O'Brien. In fact, five parking stalls are required, and we are
providing seven. So we have two extra.
MR. O'BRIEN: That would have been rough. That would not have been good. Okay, so good
answers.
MR. TARTAGLIA: Thank you.
MR. O'BRIEN: So maybe at this time, we could just bring up, for a brief presentation, Mr.
Tortorella, to discuss any of the impacts, comments with respect to traffic, onsite traffic
circulation, offsite traffic circulation, that sort of thing, and I don't necessarily want to ask all the
predicate questions unless the Board wants me to, but he's a licensed professional engineer with
Stonefield Engineering and has appeared before this Board in the past in the capacity as a traffic
engineer.
SUPERVISOR DESENA: Thank you.
MR. TORTORELLA: Thanks, Kevin. I don't know how I could beat that introduction, but good
evening, Madam Supervisor, members of the Board. For the record, excuse me, Nicholas
Tortorella, traffic engineering team lead and project manager with Stonefield Engineering and
Design, 584 Broadway, Suite 310 in Manhattan, but soon to be 1305 Franklin Avenue, Suite 225
in Garden City, which we're very excited about. So just to quickly rehash, not to belabor the
point, but our project is proposing to redevelop the somewhat outdated gas and service station at
Town Board Meeting August 11, 2026 Page 20
the southeast corner of the intersection between Hillside Avenue and North 2nd Street, opposite
side of North 2nd from the Lava Diner. Our existing site is a BP gas station with four fueling
positions, an auto service center with two service bays, a small ancillary convenience store, all of
which are accessed by two completely unrestricted full movement curb cuts on Hillside Avenue,
as well as two full movement driveways on North 2nd Street. So as Chris and Kevin alluded to
earlier, our project is proposing a complete raze and rebuild of the site to remove the auto service
component entirely, provide a new 1,250 square foot convenience store along the southern
border of the property, provide a new fueling canopy with four pumps and eight fueling positions
in the central portion of the property, seven total onsite parking spaces, inclusive of one ADA
space along the northern facade of the building, and a dedicated loading space in the southeast
comer of the property located just north of the proposed trash enclosure. But really, the most
notable improvement, as Chris kind of alluded to earlier, especially from a traffic engineering
perspective, is the access. We are going to consolidate the access on North 2nd Street by
removing the two existing curb cuts and replacing it with one full movement driveway that is
offset approximately 60 feet from the traffic signal at Hillside Avenue. That's about 50 feet of
additional separation from that intersection as compared to the site's existing northern driveway.
It's a 500 percent increase and about as far as we can possibly shift the driveway given the size of
the existing property. It's also a significant improvement to what we understand is one of the
Board's and members of the public's primary concerns about this existing site related to the
traffic flow onto and off of the property. On Hillside, we're going to remove the sea of asphalt
that's currently along that frontage and replace it with one new right ingress only driveway, and
one new right egress only driveway in addition to new ADA compliant sidewalks, pedestrian
ramps and new landscaping as well. We are going to completely prohibit left turns both entering
and exiting the site from Hillside Avenue, and these curb cuts, as Chris testified to earlier, they
will not be curb cut driveways. They will be new curb radii driveways that will actually allow us
to channelize them and promote those right turn maneuvers that we're talking about. We're also
shifting the western driveway on Hillside Avenue a few feet further away from the intersection
and designating that driveway as ingress only which is a significant improvement than the
alternative and another major circulation and safety improvement, I should say, as compared to
the current condition where vehicles can exit the site almost directly into the intersection, but not
under the control of that traffic signal. My office did prepare a trip generation analysis for the
project based on information published by the Institute of Transportation Engineers
